Great blog and i agree. It's frankly very concerning that someone in such a position can say these things without this display of ignorance being career ending

It's slightly tangential but I would like to pull at some threads regarding medical care. Sometimes the system of triage does have an adversarial nature - conditions without convenient biomarkers such endometriosis, fibromyalgia, and things under the umbrella of mental health can often be gatekept in adversarial ways. Suffering can be doubted, minimised and neglected

I enjoyed reading this. You clearly demolish Lammy’s rationale. Two points; the austerity cuts might be the cause of the backlog, reversing them will not rid us of the backlog. 2) medical gatekeeping can be adversarial. Especially in privatised systems

The backlog pre-existed COVID. The damage has been done over 30 years of successive governments. A 50% cut in budget. I am a criminal solicitor, how would you like 25 years of not seeing a pay increase? The system is totally broken. What they want is judge led trials, which will be listed 3 or 4 a day and then judges will force guilty pleas. The conviction rate will go into the 90’s with Judges as it is in the Magistrates court with District judges.

In Northern Ireland Diplock Courts consisted of one adjudicator, Judge and jury in one person. The trials were operated on the basis that the accused was guilty no matter the evidence.

Jurors carry into court their own bias, be it social status, racism, misogyny or misandry. As do Judges. Having twelve jurors functions to bring balance to the decision process, it’s not perfect but it works. That the backlog in judicial process is being used to try and repair the damage of Austerity and balance the books is an insult to the electorate and the widely held belief of a “level playing field”

Even in a left-leaning party the inexorable move to right wing thinking is evident. Lammy should be defending the rights of citizens not curtailing them.

The presumption of guilt is common these days. It's part of why people expect anyone arrested to be identified publicly by the police. Lammy, of course, should know better. Frighteningly, it reminds of when I lived in China in the 1980s. The courts there decided on punishments. Guilt was assumed if you'd been arrested, because the police wouldn't have arrested anyone innocent. Very, ahem, efficient.
